UAE court sets stricter standards for cosmetic surgeons after patient dies

The UAE’s Federal Supreme Court has issued a landmark ruling, setting a new legal precedent on the liability of plastic surgeons.

The court ruled that cosmetic surgeons are not only responsible for providing care, but must also achieve the desired result of the procedure.

The decision came from the court’s Administrative Chamber on September 1, in Appeal No. 722 of 2025.

The ruling emphasized that cosmetic surgery, unlike other forms of treatment, is often elective and not life-saving, which places a greater responsibility on the surgeon to deliver outcomes that meet the patient’s expectations and aligns with professional standards. 

The court stated that plastic surgeons are liable if the result falls short due to negligence, even if they had the patient’s consent

In this particular case, the surgeon’s deviation from accepted medical standards during a body reshaping procedure led to the patient’s death.

The judgment also clarified that doctors can be held accountable if they use risky methods that are not proportionate to the intended cosmetic outcome.

The court added that the Supreme Committee for Medical Liability’s decisions are subject to judicial review, ensuring accountability in cases of medical error.

The presiding judge also called on lawmakers to introduce clearer legislation aimed at reducing errors in cosmetic procedures.
